Effective Date: May 20, 2026These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”) and CTekk Solutions, the operator of Benzaiten LMS (“Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Acceptance of Terms
- By registering an account on Benzaiten LMS, you confirm that you have read, understood, and agree to these Terms
- These Terms apply to all users including students, administrators, and visitors
- These Terms should be read in conjunction with our Privacy Policy and Usage Policy
2. Eligibility
⚠️ You must be at least 16 years of age to use Benzaiten LMS. By using this platform, you represent and warrant that you are 16 years of age or older. Users found to be under the age of 16 will have their accounts immediately terminated.
- You must have the legal capacity to enter into a binding agreement
- You must provide accurate, current, and complete information during registration
- Accounts are for individual use only and may not be shared or transferred
3. Course Enrollment and Access
- Upon successful payment, you will be granted access to the enrolled course
- Course access is granted for lifetime unless otherwise specified at the time of purchase
- We reserve the right to update, modify, or discontinue course content to maintain accuracy and quality
- In the event a course is discontinued, we will provide reasonable notice and alternative arrangements
- Course certificates are issued upon successful completion of all required modules and assessments
4. Payment Terms
- All course fees are displayed in US Dollars (USD)
- Payments are processed securely through Stripe, our authorised payment gateway
- You agree to provide accurate and valid payment information
- All transactions are subject to Stripe’s terms of service and privacy policy
- Benzaiten LMS does not store your full payment card details on our servers
5. Refund Policy
🚫 STRICT NO REFUND POLICY: All purchases made on Benzaiten LMS are final. We do not offer refunds under any circumstances once a course enrollment has been processed and access has been granted.
5.1 Exceptions
The only exceptions to the no-refund policy are:
- Double Payment — where a user has been charged twice for the same course due to a technical error. Proof of duplicate transaction is required.
- Special Request Approval — where a refund request is submitted in writing to info@benzaitenlms.com and approved at the sole discretion of CTekk Solutions management. Approval is not guaranteed and will be evaluated on a case-by-case basis.
5.2 Refund Process
- To request a refund under the above exceptions, email info@benzaitenlms.com with your transaction ID and reason
- Approved refunds will be processed within 7–10 business days to the original payment method
- Refund requests must be submitted within 30 days of the original transaction date
⚠️ Account termination due to violation of our Usage Policy or Terms and Conditions does not qualify for a refund under any circumstances.
6. Prohibited Conduct and Malpractice
🚫 Any form of malpractice, including the installation or use of unauthorized software, hardware, browser extensions, bots, or any tool designed to tamper with, manipulate, or interfere with the operation of Benzaiten LMS is strictly prohibited. Such actions may result in immediate account termination, forfeiture of all fees paid, and potential civil or criminal legal proceedings.
- Attempting to gain unauthorized access to any part of the platform
- Using automated tools to complete courses or assessments
- Tampering with quiz timers, scores, grades, or completion records
- Sharing, selling, or distributing course content or access credentials
- Reverse engineering or attempting to extract the platform’s source code
- Any activity that disrupts the platform’s performance or availability for other users
7. Intellectual Property Rights
- All content on Benzaiten LMS including course materials, videos, assessments, graphics, and branding is the exclusive intellectual property of CTekk Solutions or its licensors
- You are granted a limited, personal, non-transferable license to access and use the content for your own learning purposes only
- You may not copy, reproduce, distribute, modify, publish, or create derivative works from any platform content
- Your completion certificates remain the property of Benzaiten LMS and are issued solely as evidence of your course completion
8. Certificates
- Certificates are issued upon successful completion of all required modules and passing all required assessments
- Certificates are for personal professional records and may not be altered, falsified, or misrepresented
- Benzaiten LMS reserves the right to revoke a certificate if it is determined to have been obtained through malpractice
- We do not guarantee that certificates will be recognised by any specific employer, institution, or regulatory body
9. Disclaimer of Warranties
- The platform is provided on an “as is” and “as available” basis without warranties of any kind
- We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components
- We do not guarantee specific learning outcomes, career advancement, or employment as a result of completing our courses
- Course content is provided for educational purposes and should not be considered as professional, legal, or technical advice
10. Limitation of Liability
To the maximum extent permitted by applicable law, CTekk Solutions shall not be liable for:
- Any indirect, incidental, special, or consequential damages arising from your use of the platform
- Loss of data, profits, or business opportunities
- Damages resulting from unauthorized access to your account
- Platform downtime or technical failures beyond our reasonable control
Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the course giving rise to the claim.
11. Governing Law
- These Terms are governed by and construed in accordance with the laws of the State of Texas, United States
- Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Dallas, Texas
- If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect
12. Modifications to Terms
- We reserve the right to modify these Terms at any time
- Significant changes will be communicated to registered users via email at least 14 days before taking effect
- Your continued use of the platform after the effective date of changes constitutes your acceptance of the updated Terms
- If you do not agree to the updated Terms, you must discontinue use of the platform
13. Termination
- We may terminate or suspend your account immediately, without prior notice, for any violation of these Terms
- Upon termination, your right to access the platform ceases immediately
- Termination does not entitle you to a refund unless it falls under the exceptions outlined in Section 5
